§ 902. Conditional uses. (See also section 2704)

  • The following uses are permitted as a conditional use in any R-2 district:

    (1)

    Any conditional use permitted in the R-1, one-family district;

    (2)

    Family day care homes or day nurseries, provided the following minimum requirements are complied with:

    (a)

    Maximum size sign allowed is a sixteen (16) square foot sign attached to the front outside of the building.

    (b)

    No excessive traffic is generated, and no obnoxious odor, noise, vibration, health hazard, or other condition detrimental to the surrounding area is produced; and

    (c)

    Certificates of inspection and approval by the county health department and the city fire department must be submitted to the building inspector prior to issuance of any occupancy permit. The occupancy permit shall be valid for one (1) year from the date of issuance and may be renewed upon inspection to determine all requirements of the original permit are being complied with. The health department shall certify as to the inspection for safety from fire hazards within the unincorporated parts of the surrounding county planning area. The conditional use and the occupancy permit shall both be automatically voided and terminated if the building inspector discovers that the health department has revoked the license of the family day care home or that the operator or licensee of any family day care home is not a bona fide resident of the residence at which the family day care home is being operated and notifies the operator, and the county health department thereof by first-class prepaid certified mail.
