§ 5-321. Purpose and intent.

  • It is the purpose of this article to regulate sexually oriented businesses and related activities to promote the health, safety, morals, and general welfare of the citizens of the area, and to establish reasonable and uniform regulations to prevent and deleterious location and concentration of sexually oriented business within the area. The provisions of this article have neither the purpose nor the effect of imposing a limitation or restriction on the content of any communicative material, including sexually oriented materials. Similarly, it is not the intent nor effect of this article to restrict or deny access by adults to sexually oriented materials protected by the First Amendment, or to deny access by the distributors and exhibitors of sexually oriented entertainment to their intended market. Neither is it the intent nor effect of this article to condone or legitimize the distribution of obscene materials. This article constitutes an amendment to the zoning ordinance and all ordinances amending or supplementing the zoning ordinance including but not limited to the Waterfront Ordinance of March 15, 1994, and all pertinent provisions of any of them shall apply to this article; provided, unless otherwise affirmatively stated herein, if any provision of this article conflict with any provisions of the such ordinances, the provisions of this article shall apply.
