§ 3109. Administration and penalties.

  • (a)

    Enforcement. The building official is hereby authorized and directed to enforce all of the provisions of this article. Upon presentation of proper credentials, the building official or his duly authorized representative may enter at reasonable times any building, structure, or premises in the city to perform any duty imposed upon him by this article.

    (b)

    Appeal from decision of the building official. The decision of the building official may be appealed to the board of appeals. A variance may be granted by the board of appeals. Decisions of the board of appeals may be appealed to the city council. All appeals shall be submitted in writing to the city clerk within thirty (30) days of the board's decision. The appellant shall cite the specific sign ordinance rule applicable to the decision rendered and the grounds for the appeal of the decision. The board of appeals must render a written decision on appeal within thirty (30) days of receipt of the appeal by the city clerk, and the matter will then be forwarded to the city council for a decision. The city council will render a written decision within sixty (60) days of receipt of the appeal from the city clerk, unless there is a mutual agreement for a time extension. The appeal of such decision of the city council shall be as provided by law.

    (c)

    Penalties. Any person, firm or corporation violating any of the provisions of this article shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be fined not more than one hundred dollars ($100.00) plus the costs incurred by the city with regard to the removal of any signs and the repair necessitated by such removal or repair for maintenance purposes. The owner of any sign, building or premises, or part thereof, where anything in violation of this article shall be placed, or shall exist, and any person who may have knowingly assisted in the commission of any such violation, shall be guilty of a separate offense.
