§ 8-17.1. Legal hours for sale of alcoholic beverages, light wine and beer for on premises consumption; establishment of closing time for the holder of a permit authorizing the sale of beer, light wine or other alcoholic beverages for consumption on the premises.

  • (a)

    It shall be unlawful for the owner, operator or employee of any business establishment which has a permit for on premises consumption of alcoholic beverages, light wine and beer to sell, or to serve, to any patron or customer any alcoholic beverages, light wine or beer between the hours of 2:00 a.m. and 7:00 a.m. of the same day. It shall further be unlawful for the owner, operator or employee of such establishment to allow alcoholic beverages, light wine or beer to be consumed by, or to be accessible to, customers or patrons on the premises between the hours of 2:00 a.m. and 7:00 a.m. of the same day.

    (b)

    It shall be unlawful for any nightclub, bar, restaurant, tavern, dance hall, banquet hall or any similar business engaged in the sale of beer, light wine, or other alcoholic beverages for consumption on its premises to conduct business or otherwise remain open to the general public between the hours of 2:00 a.m. and 7:00 a.m. on any day of the week.

    (c)

    The provisions of section 8-17.1(a) and (b), above, shall not apply to businesses granted resort status by the Mississippi State Department of Revenue, nor shall it apply to businesses that are regulated by the Mississippi Gaming Commission.

    (d)

    Any person who shall violate the provisions of this section 8-17.1 shall be guilty of a misdemeanor, and shall be punished by a fine of five hundred dollars ($500.00) for the first offense and seven hundred fifty dollars ($750.00) for subsequent offenses, plus any applicable assessments.
